HedgeStreet provides certain Settlement Information that HedgeStreet believes to be reliable and accurate. However, HedgeStreet neither assumes reasonability for nor guarantees the accuracy, completeness, timeliness or usefulness of such Settlement Information. "Settlement Information" includes, but is not limited to, the release or posting of underlying prices and settlement data, times, results, and general statistics.

Changes in Settlement Data Release Date/Time

If settlement data is delayed or released early for any reason, HedgeStreet may adjust the terms of an outstanding Series as it deems appropriate in its discretion to achieve fairness to holders of Contracts of the affected Series. In the event of a delayed release of the settlement data from its scheduled release date or time, HedgeStreet may postpone the Settlement Date of the instrument until the settlement data has been released. In the event that the settlement data is issued before its scheduled release date or time, HedgeStreet may halt trading and settle the affected Series with the settlement data from the early release on or before the affected Series' scheduled Settlement Date.

HedgeStreet will make every effort to suspend the market in a timely manner in order to achieve fairness to holders of contracts of the affected Series. However, HedgeStreet is not responsible for any loss or damage sustained by any member for trades executed after the early release of the settlement data, prior to HedgeStreet's halting of the affected Series.

In the event that, during the term of a Series, changes beyond the control of HedgeStreet occur in the settlement data, including, but not limited to, non-release of the settlement data, HedgeStreet may adjust the settlement terms of the outstanding Series as it deems appropriate in its discretion to achieve fairness to holders of contracts of the affected Series.

Accuracy of Settlement Data and Information

HedgeStreet is not liable in any manner whatsoever, for any loss or damages sustained by a member as a result of any actual or proposed transaction as a direct or indirect result of any services provided by HedgeStreet, including, but not limited to, any inaccurate information provided by a HedgeStreet settlement data provider.

Changes to Calculation of Settlement Data

HedgeStreet is not responsible for any loss or damage sustained by a member as a result of any actual or proposed transaction as a direct or indirect result of any services provided by HedgeStreet, including, but not limited to, changes or modifications made to the collection, composition, methodology, calculation, or any other aspect of an affected Series' settlement data.

Defined Payout Criteria

If the Payout Criteria of an affected Series is unclear on the Settlement Date, HedgeStreet may, at its sole discretion, delay settlement of the Series until the outcome is clear to HedgeStreet as determined by reasonable means.
